In una fase di forte crescita e trasformazione del mercato — tra la fine della maggior tutela, l'entrata in vigore di ETS2 e la diffusione delle comunità energetiche — il presidio legale non è una funzione di supporto: è un fattore competitivo.

IL RUOLO

Siamo alla ricerca di un/una Senior Legal Counsel con solida esperienza nel settore energetico, capace di operare in modo autonomo su dossier complessi e di essere interlocutore diretto con le funzioni di business. La figura è inserita all’interno dell’ufficio legale di Fastweb e collabora quotidianamente con i team di Product, Regulatory, Sales, Trading e Operations.

RESPONSABILITÀ

- PRINCIPALI

- Contrattualistica e Trading

La figura gestirà la contrattualistica di acquisto energia e gas— inclusi i contratti standard EFET (GTMA, ISDA, accordi di bilanciamento) — e supporterà la strutturazione di PPA con produttori da fonti rinnovabili. . Supporterà la valutazione di operazioni di partnership, accordi commerciali e potenziali operazioni di M&A; con impatti anche sotto il profilo della concorrenza. Sul fronte retail, presidierà la redazione e la negoziazione dei contratti di fornitura per clienti mass market, PMI e large corporate, con particolare attenzione alla coerenza tra le condizioni contrattuali e il posizionamento di offerta dell'azienda.
- Rapporti con i Distributori (DSO)

La figura gestirà le relazioni contrattuali e le controversie con i principali distributori sul mercato presidiando le problematiche di switching, morosità, distacchi e misura.



Dovrà pertanto avere dimestichezza con le delibere di riferimento ARERA e dei processi SII, e saper trattare con i referenti legali delle DSO in modo efficace.
- Tutela del Consumatore, Codice del Consumo e monitoraggio della normativa di settore

La conformità al Codice del Consumo (D.Lgs. 206/2005) e alle disposizioni ARERA sulle pratiche commerciali è un altro aspetto centrale. La figura sarà il presidio principale su questo fronte: revisione delle comunicazioni precontrattuali, valutazione delle campagne commerciali, gestione dei reclami in escalation. Dovrà saper lavorare in modo costruttivo con il team Sales, come garanzia di sostenibilità.

Requisiti essenziali

- Laurea magistrale in Giurisprudenza
- Abilitazione all'esercizio della professione forense (preferibile)
- Almeno 5 anni di esperienza in studi legali specializzati in energy o in posizioni in-house nel settore
- Conoscenza approfondita del Codice del Consumo applicato ai contratti di fornitura di energia elettrica e gas
- Esperienza diretta con la contrattualistica EFET (GTMA, ISDA, Annex) e/o contratti PPAE, sperienza concreta nella gestione dei rapporti legali con i distributori (DSO), conoscenza della contrattualistica e delle delibere ARERA
- Capacità di produrre pareri scritti chiari, sintetici e orientati alla decisione
- Inglese professionale fluente
- Capacità di gestire in futuro eventuali risorse junior

Elementi differenzianti
- Conoscenza dei processi gestiti sul Sistema Informativo Integrato(SII)
- Familiarità con le piattaforme GME e i meccanismi di bilanciamento
- Esperienza in procedimenti ARERA o AGCM
- Interesse attivo per la transizione energetica (CER, storage, PPA da rinnovabili)

APPROCCIO E MENTALITÀ Più che un elenco di competenze, cerchiamo un orientamento: chi entra in questo ruolo deve voler capire le dinamiche e gli sviluppi del business, non solo tutelarlo. Deve essere a proprio nella complessità normativa e trasformarla in chiarezza operativa per chi lavora ogni giorno con clienti.

Retribuzione a partire da 40.000 euro annui lordi + PdR.
